Edward Henry: Notable case

R v P&P (Southwark) (2015)

On 20th September 2015 a company director (Mr L) pleaded Guilty personally & on behalf of the company, to transporting waste electrical & electronic equipment to a non OECD country contrary to Regulations 23 & 55 of The Transfrontier Shipment of Waste Regulations 2007. The particulars of the Count to which the defendant personally pleaded guilty set out that
...between the 24th September 2013 and 27th September 2013 Waste Electrical & Electronic Equipment including Hazardous Waste was transported in shipping container TRLU581727 that was destined for recovery in Ghana.
Edward Henry successfully challenged the two year Company Director disqualification order imposed upon the defendant in a recent sentence appeal before the Court of Appeal. The Court quashed the disqualification, accepting that it was excessive and otiose given the suspended sentence imposed upon the director in question..

No impairment and no warning in a case of admitted dishonesty
