Summary
Ben FitzGerald prosecutes and defends in cases of serious and organised crime. He has appeared as junior counsel in a number of high-profile and complex cases at the Old Bailey and elsewhere. He also leads prosecution and defence teams in serious criminal cases, from large-scale frauds to drug-trafficking and sexual offending. He has in-depth knowledge of confiscation issues, having acted in a leading case on the division of marital assets.
He uses the experience and expertise built through such cases to defend professionals and companies who find themselves the subject of criminal proceedings. He has acted in serious and high-value cases of alleged fraud, copyright infringement and breaches of health and safety law.
He has considerable experience of regulatory and disciplinary proceedings. He has represented the General Medical Council in a case of serious professional misconduct concerning the hazardous prescribing of opiates. He is regularly instructed to act in the General Social Care Council.
Ben was until recently instructed as first junior Counsel to the Public Inquiry into the Mid Staffordshire NHS Foundation Trust.
He is also experienced in Coroner’s proceedings, having acted as counsel to the inquest in the case of the violent death of a barrister’s clerk.
