Practice: Crime and Regulatory

Summary

Joanna is presently a door tenant with QEB Hollis Whiteman Chambers and is not currently practising as she is on extended maternity leave. She was called to the Bar in 2004 and, when practising, is dedicated to providing the highest quality advice, assistance and advocacy.

Her main areas of practice are criminal law and professional regulation.


Career Details

Joanna Warwick has prosecuted and defended in a wide range of criminal cases in the Youth Court, Magistrates’ Court, Crown Court and the Court of Appeal.

She has been instructed as junior counsel, both for defence and prosecution, in cases of serious and complex crime including multi-national terrorism, murder, attempted murder, medical fraud and armed robbery. She also has defence and prosecution experience in cases involving restraint and confiscation.

In addition to general crime, Joanna has experience in regulatory law, appearing before the General Medical Council, General Dental Council and the Nursing and Midwifery Council.

She is regularly instructed to appear on behalf of the Security Industry Authority, the body which regulates the private security industry, in relation to appeals against decisions made by the body or the appeal tribunal.

She also has experience of trading standards prosecutions and has appeared before the Magistrates' Court to prosecute safety offences and breaches of consumer protection law.

Criminal Law

Joanna defends and prosecutes in a wide range of criminal cases and considers it her priority to take a thorough and considered approach to all her cases.  Joanna’s cases have included the prosecution and defence of armed robbery, serious assaults, public disorder, possession and supply of drugs, possession of weapons, firearms offences, sexual offences (including historic sexual allegations and rape) and offences of fraud and theft. 

As a led junior, Joanna has experience in cases of a complex and serious nature including murder, attempted murder, serious violent offences, conspiracy to rob, historical and sensitive sexual offences and high-value frauds.   Joanna has also been part of the prosecution team in the preparation and trial presenting of two multi-national terrorism cases.

Joanna is not only confident with all aspects of the criminal trial itself but also with matters which may follow a conviction, including experience with confiscation proceedings commenced under the Proceeds of Crime Act 2002 and advising and appearing in the Court of Appeal. 

She also has experience of trading standards prosecutions and has appeared before the Magistrates' Court to prosecute safety offences and breaches of consumer protection law.

Professional Regulation

When a professional finds that they are being investigated and prosecuted by their Regulatory Body for alleged misconduct, lack of incompetence or upon health grounds Joanna appreciates that these proceedings are of great significance not only to the individual facing proceedings but to the general public, who depend upon effective and fair regulation of professionals.  This is particularly true of those employed in healthcare and it is in this field that Joanna’s regulatory practice is focused.

Joanna uses the analytical and preparation skills developed throughout her criminal practice to prepare cases to a high standard and thereafter is able utilise her confident advocacy skills to ensure effective representation in disciplinary tribunals.

Joanna appears in a number of different tribunals and has experience defending and presenting cases in this field.   She regularly appears in a number of regulatory bodies, particularly in the Nursing and Midwifery Council (NMC) and the General Dental Council (GDC) but also has experience in the General Medical Council (GMC) and the General Social Care Council (GSCC).

Joanna recently was seconded to Field Fisher Waterhouse solicitors and she worked closely with their Public and Regulatory Group to provide advice, support and gave assistance to them in the investigation and preparation of cases being brought before the NMC.

Public Access

It is now possible in certain circumstances for members of the public to instruct a Barrister directly to provide advice and to appear in legal proceedings.  Joanna is registered with the Bar Council Public Access Directory and is qualified to accept instructions on a direct access basis.
