David Groome and Ari Alibhai win landmark ruling - Judgment Handed Down - 05.11.2009 Scopelight Limited Anton Vickerman Kelly-Ann Vickerman -v- Chief of Police for Northumbria Federation Against Copyright Theft [2009] EWCA Civ 1156 Lord Justice Ward Lord Justice Wilson & Lord Justice Leveson Instructed together with Richard Spearman QC, David Groome and Tom Weisselberg on behalf of the Federation Against Copyright Theft and the Chief Constable of Northumbria Police on appeal from the High Court of Justice against a determination of a preliminary issue as to the proper construction of section 22 of the Police and Criminal Evidence Act 1984 (“PACE”). Sharp J, at first instance, determined that the police had no power under PACE to retain seized property (following a decision not to prosecute by the Crown Prosecution Service (“CPS”) to allow a private prosecutor to consider bringing a private prosecution, nor any power, once a private prosecution was mounted, to retain the property for its use therein. Appeal allowed. Police retain a discretionary power through PACE to retain property seized from potential defendants in criminal proceedings once the CPS decide not to prosecute.
