Health and Safety: Notable case

R v Counsell (2014)

Adrian Darbishire QC acted on behalf of Mr Counsell, who was accused of causing the M5 motorway accident in November 2011.

Following representations made by the defence earlier on this year, the manslaughter charges were discontinued by the CPS.

In November 2013 the trial started on allegations that Counsell failed to ensure public safety. On the 10th December 2013 the Judge directed the jury to find Counsell not guilty due to insufficient evidence.
