    Experience 

    The mainstay of Kerry’s Financial Crime practice is serious fraud and many of her cases involve a significant international dimension. 

    Kerry routinely advises both individuals and corporates on sensitive areas, including most recently a professional who had fled the jurisdiction and had been convicted and sentenced in absence of fraud.

    She was junior counsel in a multi-agency operation uniting CPS Special Casework, UKBA, DWP and HMRC in the successful phased prosecutions of 15+ defendants for a multimillion-pound benefits and immigration fraud conspiracy stretching back almost 20 years (Operation Spenser/R v Nabuguzi & Others). She was also junior counsel in the successful prosecution of six defendants who committed multimillion-pound identity fraud over a period of seven years which targeted Eurostar, the Department for Work and Pensions, the Home Office, and HM Revenue and Customs (Operation Boromo/R v Ndoli & Others). 

    She was instructed by the Serious Fraud Office (SFO) to lead the disclosure team in relation to the collapse of the hedge fund "Weavering Capital" and the prosecution of its founding director Magnus Peterson. 

    Kerry advises on legal professional privilege and has been instructed in a number of substantial privilege reviews for financial institutions and law firms. She has undertaken prosecutions for HMRC’s MTIC team in allegations of missing trader intra-community fraud. She has also advised corporates on the private prosecution of employees suspected of fraud.

    Kerry has provided bespoke training to the Corporate Crime departments of international law firms, advising them on the reality of a criminal case and how to arm yourself against the prosecution.

    R v Nabuguzi & Others (2012-2017)
    Paul Raudnitz and Kerry Broome have led a series of prosecutions as part of Operation Spenser – a multi-agency Investigation uniting the UKBA, DWP and HMRC. Operation Spenser targeted a multimillion-pound immigration and benefit fraud stretching back over 20 years.

    SFO v Petersen (2014)
    Kerry Broome was instructed by the SFO to lead the disclosure team for the SFO in relation to the collapse of the hedge fund "Weavering Capital" in 2009. Magnus Peterson was successfully prosecuted for offences of false accounting, fraudulent trading, fraud by abuse of position, fraud by misrepresentation and forgery.   

    R v Ghasemi & Others (2014)
    Linda Strudwick and Kerry Broome prosecuted a number of family members for conspiracy to money launder the proceeds of an international export business of plant machinery, which was stolen in the UK for onward sale in the UAE. 

    R v Frauts & Lynch (2010)
    Kerry Broome was instructed as disclosure junior in the SFO prosecution of the management team of a healthcare services company which provided support for children and young people with autism and who fraudulently obtained over £1.2 million, much of which was from local authorities' social services budgets. The main defendant was extradited from Canada.

    Experience

    Kerry defends and prosecutes a wide range of the most serious criminal offences including homicide, firearms offences, drug trafficking, violence, kidnapping, sexual offences, robberies and Health and Safety violations. Many of her cases involve complicated expert evidence and/or cross-examination of young or vulnerable witnesses. 

    She is often instructed to advise and represent professionals charged in criminal proceedings. Most recently she successfully defended a young man of impeccable character who had been subjected to domestic abuse by his then partner but it was he who was charged with assault (R v HH, 2017).  

    She was recently instructed by the law officers to appear in the Court of Appeal in relation to an unduly lenient sentence following the prosecution of four individuals for kidnapping and robbery in which she was instructed as prosecution counsel (R v Hendrey-Fevrius & Others). 

    As leading junior counsel she successfully prosecuted a criminal gang of seven individuals who committed a series of armed robberies subjecting the victims to gratuitous violence. The trial at the Central Criminal Court lasted 10 weeks (R v Carbon & Others). 

    Kerry is often instructed to defend allegations of serious sexual offences and child cruelty. She successfully defended the mother of three children, accused of vicious and systematic child cruelty. Following two aborted trials and an abuse of process application founded upon the crown’s disclosure failures, no evidence was offered and the court awarded wasted costs in favour of the defence (R v GH).

    Kerry has in depth experience of health & safety matters.  She was instructed by the CPS to prosecute Andrew Hill, the pilot charged with the manslaughter of 11 people following the Shoreham Airshow disaster.  She was led by Tom Kark QC.

    She advises both the prosecution and defence pre-charge, including on matters of disclosure and sufficiency of evidence.      

    Kerry also provides training to other lawyers and investigators, most recently providing training to Home Office criminal investigators across the country on disclosure.

    A Grade 4 prosecutor, Kerry’s skill set, successes and subsequent reputation as an expert in serious general crime has led to her becoming Treasury Counsel.

    Tom Kark QC and Kerry Broome were instructed by the CPS to prosecute Andrew Hill, who was charged with the manslaughter of 11 people when his ex-military jet crashed onto the A27 in Sussex on 22 August 2015.

    R v Gabriel, Gabriel and Gabriel (2019)
    Prosecuted identical triplets Ricky, Reiss and Ralston Gabriel. Ricky and Ralston were convicted of conspiracy to possess firearms with intent to endanger life. Reiss was convicted of the same charge and also pleaded guilty to possession of a prohibited firearm and possession of Class A drugs with intent to supply. 

    R v McErlean (2019)
    Prosecuted Luke McErlean, whose Mercedes collided with actress Linda Bassett’s nephew Dominic Bassett. Mr McErlean admitted causing death by dangerous driving.

    R v Thomas (2018)
    Prosecuted Aron Thomas, who was convicted of two counts of conspiracy to possess a firearm with intent to endanger life.

    R v Neron Quartey (2018)
    Prosecuted Neron Quartey, who was convicted of the murder of a youth worker, Kwabena Nelson, in North London. Kerry was led by Simon Mayo QC.

    R v Simone Fergus (2018)
    Prosecuted Simone Fergus, who pleaded guilty to the manslaughter of her partner, Raul Chiriac.

    R v Bipin Desai (2017)
    Prosecuted pharmacist who admitted assisting his father's suicide prosecuted for murder. Kerry was led by William Boyce QC.

    R v GH (2015)
    Kerry Broome was instructed to defend the mother of three children accused of child cruelty over a number of years. It was alleged that she regularly beat the children, forced them to sit in stress positions and bit her eldest child.

    R v Lidstone (2014-2015)
    Kerry Broome defended Nicholas Lidstone, a former police officer who pleaded guilty to 13 offences of child abuse which include multiple allegations of rape.

    R v Carbon & Others (2014)
    Kerry Broome prosecuted seven members of a criminal gang who committed a series of armed robberies and an aggravated burglary in East London in the summer of 2013.

    R v Desmangles & Others (2013)
    Kerry Broome prosecuted a gang of six drug dealers who were sentenced to a total of 72 years following convictions for their role in a conspiracy to supply over 50kg of heroin. 

    R v IM (2012)
    Kerry Broome successfully defended IM who was alleged to have sexually abused the teenage daughter of a family friend over a period of six years when she had previously been sexually abused by two other family friends on separate occasions.

    R v VS (2011)
    Kerry Broome was junior defence counsel for an immigration officer who was charged with facilitating unlawful immigration and misconduct in public office.

    R v Clarke & Others (2010)
    Kerry Broome represented one of three defendants who perpetrated a multimillion-pound identity fraud spanning over a decade and which targeted the DVLA, numerous financial institutions, the Department of Work and Pensions and local councils.

    She presents cases and represents individuals before the GDC, the GCC, the MPTS and the NMC. She was recently instructed by the GDC in a case involving eight patients who received extremely poor treatment and suffered permanent harm. She is also representing a chiropractor who faces three separate sets of fitness to practise proceedings concerning a range of issues.

    GDC v Zarei-Soghanloo (2015)
    Kerry Broome presented the case on behalf of the GDC against Dr Zarei-Soghanloo who faced an allegation of sexual misconduct against one of his employees.  

    GCC v Zahedi (2014)
    Kerry Broome was instructed on behalf of the GCC. Mr Zahedi faced an allegation of poor treatment in relation to a number of patients including that he failed to notice that one of his patients had an unstable neck and his treatment of this patient could have caused paralysis or worse. Following a finding of misconduct, Mr Zahedi was erased.
