Rape conviction quashed in the court of appeal

Edward Henry QC (instructed by Shaw Graham Kersh) succeeded in overturning a wrongful conviction for rape on 19th Nov 2019 before the Court of Appeal (Bean LJ, Laing J, and Sir Nicholas Blake).

Edward took over the Appellant’s case in February 2019, previous counsel and solicitors having advised that the conviction in November 2017 was unappealable. Edward obtained leave to appeal on six grounds by leave of McGowan J who also granted an extension of time of 460 days. At the hearing five of the six grounds were upheld, but two were considered determinative. The conviction was quashed as a result of the trial judge’s failure to give a structured direction on bad character, and because of a significant misdirection concerning the Appellant’s previous convictions.
