Double Jeopardy murder conviction

William Boyce KC and Karen Robinson prosecuted David Smith for the murder of Sarah Crump in 1991. Smith had been tried for, and acquitted of, the murder in 1993. Following an investigation by the Metropolitan Police Service Cold Case team, an application was made to the Court of Appeal Criminal Division to quash the acquittal and order a retrial, under the ‘double jeopardy’ legislation. Unusually, the ’new and compelling’ evidence on which the application was based comprised almost entirely evidence of bad character, primarily Smith’s subsequent conviction for murder of another woman, in very similar circumstances.
