Confiscation success after 5 day hearing

In a judgment given on the 21st May by HHJ Spragg at Newcastle Crown Court, a confiscation order was made in the amount of only £8907.08. This was in circumstances where the prosecution had been seeking a confiscation order in the amount of almost £2 million.

The judgment followed a contested confiscation hearing, where evidence was called over the course of 5 days on the issue of benefit from general criminal conduct. Lengthy written submissions were then made on issues including proportionality and compensation. Polly was privately instructed by Liberty Solicitors. She co-defended with Philip Hackett QC, of the 36 Group.
