QEB Hollis Whiteman is pleased to publish the third edition of its POCA Advisory and Asset Forfeiture (PAAF) Newsletter.
This latest issue provides analysis and commentary on recent developments in proceeds of crime advisory work, asset seizure and anti-money laundering. We consider R v Osmond [2026] EWCA Crim 979, a rare example of a ‘tipping off’ prosecution. The Court of Appeal’s decision also has implications for ‘reasonable excuse’ for failing to report to the National Crime Agency. We also cover the latest AML and POCA developments, including the FCA’s preparations to take over as AML supervisor for the legal and accountancy sectors, ML risk affecting the gambling sector and new cases referring to the POCA amendments introduced on 29 June 2026.
This edition also includes a table on the amendments to POCA introduced by the Crime and Policing Act 2026. Many of these amendments came into force on 29 June 2026, while others are yet to take effect. We summarise what is in force and their practical effect.
