GDC v Ashraf (2014) EWHC 2618

The dentist was successfully prosecuted by Lydia for three separately orchestrated NHS frauds in respect of which he had previously been acquitted in the crown court. Lydia successfully argued both before the Council's tribunals and the High Court that the regulator's prosecution was not an abuse of the process. The case is the current leading authority in respect of the prosecution of failed criminal allegations and resisted arguments on appeal of ‘double jeopardy’.
