R v Boscolo Gnolo (2016)

David Spens QC represented a young woman who suffocated her two-month-old child to death and left her body in a rubbish bin.

There was debate as to whether the prosecution should accept a plea to infanticide or manslaughter by virtue of diminished responsibility. A developing and highly emotive and sensitive area of the law.

The debate about the possible offences to which the defendant might consider a guilty plea were highly complex, and the work of leading counsel in acting in the client’s best interests extremely delicate and challenging.
