Adam King defended former Derbyshire Police constable Shaun Elliott, who was found not guilty of assault occasioning actual bodily harm following a trial at Derby Crown Court.
The prosecution alleged that Mr Elliott assaulted Kian Green during an arrest outside Buxton Police Station in December 2022 by striking him with a baton while Mr Green was in the rear of a police van.
Mr Elliott's case was that he had acted with lawful purpose to neutralise what he believed was a threat after he thought Mr Green was going to bite another police officer. Mr Elliott told the jury that his priority was the safety of his colleagues, himself and Mr Green.
Following trial, the jury returned a verdict of not guilty.
