David Jeremy KC, on his third return to the Court of Appeal representing Ben Field, secures a judgment acknowledging that the Court had been wrong to dismiss Field’s first appeal in March 2021.
Following Field’s conviction of the murder of Peter Farquhar in August 2019, David Jeremy conducted a first appeal against conviction on the grounds that the jury had been misdirected on causation ([2021] EWCA Crim 380), then an application to re-open the appeal on the grounds that the court that dismissed the first appeal had displayed bias and unfairness ([2022] EWCA Crim 316), and now, following a successful application to the CCRC on the grounds of both fresh argument of law and exceptional circumstances, a second, successful, appeal.
A retrial has been ordered and the prosecution given leave to appeal to the Supreme Court.
