MHRA Prosecution Dismissed (2015)

Adrian Darbishire and Rhys Meggy were instructed to defend a pharmaceutical manufacturer, P Ltd., and a senior manager of that company.

The company and senior manager of the company were charged by the Medicines & Healthcare Products Regulatory Agency with the unlawful supply of industrial quantities of controlled drugs (in all, 5 tonnes of class C drugs were transferred).  The company was charged as principal and the manager on the basis of his consent or connivance, alternatively his neglect.  Following the submission of written arguments in support of a dismissal application, in early June the prosecution offered no evidence on all charges.  Section 19 costs are now being sought.  Three co-defendants pleaded guilty and are to be sentenced.
