Fraser Coxhill of QEB Hollis Whiteman represented Police Sergeant Tim Hannah before the Police Appeals Tribunal, which allowed his appeal and overturned the original misconduct panel's findings of fact, misconduct and the Final Written Warning imposed following a misconduct hearing in September 2024.
Fraser successfully argued that the original panel had made a fundamental procedural error by refusing to permit key evidence which could have materially affected the decision.
After reconsidering the case, the Tribunal determined that the remaining allegations relating to the workplace incident, an historical photograph and alleged inappropriate language should not be upheld.
Fraser did not appear at the original misconduct hearing but was instructed by Rob Newbould of Blackfords Solicitors in respect of the appeal.
