R v SM (2019)

Eloise represented SM, a mother facing trial for one count of sending a threatening communication, contrary to Section 1(1) of the Malicious Communications Act 1988, in that it was alleged she had sent her ex-partner, and father of their child, a number of threatening and ultraviolent e-mails for the purpose of causing distress or anxiety to him.

Eloise mounted a successful legal argument to exclude the totality of the electronic evidence relied upon by the Crown, the result of which meant the Judge’s decision was a terminating ruling, bringing the case to an end before reaching trial.
